The law of value and the analysis of underdevelopment.John Weeks - 1997 - Historical Materialism 1 (1):91-112.
Karl Marx entitled his first major work on the theory of capitalism an Introduction to the Critique of Political Economy, not, it should be stressed, An Introduction to … Political Economy. The inclusion of the crucial ‘the critique of provides the key to Marx's break with classical political economy. As much as he respected the contribution of bourgeois writers, especially Ricardo, he did not consider himself a radical member of the political economy school. That the political economy school's most outstanding (...)

Medicalization of Rural Poverty: Challenges for Access.Elizabeth Weeks - 2018 - Journal of Law, Medicine and Ethics 46 (3):651-657.
This article provides a broad survey of issues facing rural communities and suggests that medicalization of poverty concepts and interventions need to be tailored to those populations. Rural poverty may be both broader and deeper than in urban areas. Those challenges seem to produce a constellation of health conditions, as rural residents struggle with unemployment and lack of opportunities. Relatedly, rural communities struggle to maintain financially viable hospitals and specialty providers. The article closes by offering a snapshot of rural-specific strategies (...)

  10. Between Positivism and Phenomenology: Brentano's Philosophy of Science.Anderson Weekes - 1996 - Dissertation, State University of New York at Stony Brook
Brentano plays a paradoxical role in the history of philosophy. He is the key transitional figure between two antithetical traditions: although a profound influence to phenomenology, Brentano himself was inspired by the positivism of Comte and Mill. While his students found in his teachings both a reason and the means to combat the spirit of positivism, Brentano himself believed "the true method of philosophy was nothing other than the method of the natural sciences." The incoherence of his historical role is (...)

Tort Claims Analysis in the Veterans Health Administration for Quality Improvement.William B. Weeks, Tina Foster, Amy E. Wallace & Erik Stalhandske - 2001 - Journal of Law, Medicine and Ethics 29 (3-4):335-345.
Tort claims have been studied for various reasons. Several studies have found that most tort claims are not related to negligent adverse events and most negligent adverse events do not result in tort claims. Several studies have examined the disposition of tort claims to understand the likelihood of payment once a claim has been made. Still others have proposed that tort-claims trend analysis may help administrators target their quality-improvement efforts and identify problems with quality that would not otherwise be captured. In (...)

Teaching Health Law: Teaching Sicko.Elizabeth Weeks Leonard - 2009 - Journal of Law, Medicine and Ethics 37 (1):139-146.
In long Midwestern winters, two things are certain: snow and basketball. But two things that you cannot count on are snow day school closures and a home-team collegiate basketball championship. In Kansas last winter, we had both. Winter precipitation was much above average, resulting in a rare invocation of the University's inclement weather policy to cancel classes in early February. And the Kansas Jayhawks basketball team brought home the National Collegiate Athletic Association championship trophy for the first time in two (...)

Do terminally ill patients who have exhausted all other available, government-approved treatment options have a constitutional right to experimental treatment that may prolong their lives? On May 2, 2006, a divided panel of the U.S. Court of Appeals for the District of Columbia, in a startling opinion, Abigail Alliance for Better Access to Developmental Drugs v. Von Eschenbach, held “Yes.” The plaintiffs, Abigail Alliance for Better Access to Developmental Drugs and Washington Legal Foundation, sought to enjoin the Food and Drug (...)

Although ultimately overturned by the full court, Abigail Alliance generated considerable interest from various constituencies. Rhetorical Federalism: The Role of State Resistance in Health Care Decision-Making.Elizabeth Weeks Leonard - 2011 - Journal of Law, Medicine and Ethics 39 (s1):73-76.
The Patient Protection and Affordable Care Act represents the most significant reform of the United States health care system in decades. ACA also substantially amplifies the federal role in health care regulation. Among other provisions, ACA expands government health care programs, imposes detailed federal standards for commercial health insurance policies, creates national requirements on employers and individuals, and enlists state administrative capacity to implement various federal reforms. In response, a persistent voice in the protracted, contentious debate surrounding ACA was, and (...)

    Stigmatizing the Unhealthy.Jessica L. Roberts & Elizabeth Weeks - 2017 - Journal of Law, Medicine and Ethics 45 (4):484-491.
Stigma can lead to poor health outcomes. At the same time, people who are perceived as unhealthy may experience stigma as the result of that perception. As part of a larger project examining discrimination on the basis of health status or “healthism,” we explore the role of stigma in producing disadvantage based on health status. Specifically, we look to the principles of health equality and health justice. An intervention violates health equality when it is driven by animus, which can be (...)

    Juricas: Legal computer advice systems. [REVIEW]J. G. L. Weeks - 1992 - Artificial Intelligence and Law 1 (4):275-290.
In the late seventies at the Centre for Computers and Law research was started to find means for supporting lawyers' work with the aid of a computer. The research project was called JURICAS. In 1982 a prototype of a JURICAS system was produced and since 1986 seven advisory packages have been brought out on the market in the Netherlands. These packages consist of two main parts, an author's shell and an advisory program. The user cannot make changes to either the (...)

Disparities exist in the health, livelihood, and opportunities for the 46-60 million people living in America’s rural communities. Rural communities across the United States need a new energy and focus concentrated around health and health care that allows for the designing capturing, and spreading of existing and new innovations. This paper aims to provide a framework for policy solutions to build a healthier rural America describing both the current state of rural health policy and the policies and practices in states (...)

Terror in time: extending culturomics to address basic terror management mechanisms.Mark Dechesne & Bryn Bandt-Law - 2018 - Cognition and Emotion 33 (3):492-511.
ABSTRACTBuilding on Google's efforts to scan millions of books, this article introduces methodology using a database of annual word frequencies of the 40,000 most frequently occurring words in the American literature between 1800 and 2009. The current paper uses this methodology to replicate and identify terror management processes in historical context. Variation in frequencies of word usage of constructs relevant to terror management theory are investigated over a time period of 209 years. Study 1 corroborated previous TMT findings and (...)

Do Physicians/Researchers Trade Stock Based on Privileged Information? A Closer Look at Trading Patterns Surrounding the Annual ASCO Conference.Elie Donath & Mark J. Eisenberg - 2012 - Journal of Law, Medicine and Ethics 40 (2):391-393.
The goal of this paper was to assess whether, given the opportunity, physicians/researchers would try to profit (by trading stocks) from information that only they were made privy to. The Annual ASCO (American Society of Clinical Oncology) Conference, the largest annual oncology conference, provided the perfect venue to fully explore this question. Up until 2008, ASCO abstracts were released exclusively to ASCO members (i.e., physicians, oncologists) two weeks prior to the conference, and many speculated about unusual trading patterns (...)

There is a concern that physicians/researchers are inappropriately profiting from information derived from advance copies of high-impact clinical trial data distributed by medical conferences or journals. Despite these concerns, it has never been systematically evaluated, and little is known about the degree to which it exists. This is largely due to difficulties associated with directly verifying whether or not such activities have taken place and, furthermore, many medical conferences/journals today have taken the necessary actions to guard against this. One medical (...)
